Please review and understand the following Terms of Use. By using this platform, you acknowledge and accept these terms. If you fail to comply, InMyTrip reserves the right to immediately restrict or terminate your access and usage rights to the platform. This may include removing any non-compliant information, as specified by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. By interacting with the InMyTrip platform and using our services, you agree to abide by these terms. If you do not agree with them, please refrain from using the platform and its services.

1. Acceptance of Terms

EMBELLISHED DREAM TOURS PRIVATE LIMITED, an Indian company registered under the Companies Act, 2013, and based at 73/2, Kamalnagar, Mirjanhat, Bhagalpur, Bihar (referred to as "INMYTRIP"), operates and manages the Platform. This Platform includes online resources such as classified advertisements on the website www.inmytrip.com and its mobile application, as well as an online service that connects tourism service providers with selected partners on www.inmytrip.com (collectively referred to as the "Service"). Both the Service and the Platform, including their websites and mobile applications, are governed by these INMYTRIP Terms of Use ("Terms").
For the purposes of these Terms, “you” ,”your”, “Users” refer to any individual who accesses or uses the Platform or the Service, whether manually or automatically. This includes individuals browsing the Platform, sharing tourism information for price estimates, posting comments or content, or responding to advertisements on the Platform. By using the Service, you agree to comply with these Terms. Furthermore, when using specific parts of the Service, you agree to follow any applicable guidelines. These guidelines may be modified or updated at INMYTRIP's sole discretion. It is your responsibility to periodically review these Terms. If you disagree with any term, condition, guideline, or any subsequent changes, or if you are dissatisfied with INMYTRIP or the Service, your only option is to immediately stop using INMYTRIP.
INMYTRIP reserves the right to modify these Terms at any time at its sole discretion. Notices of changes to the Platform or the Terms may be sent to you by INMYTRIP as described in Section 4.21 (4). Although INMYTRIP may provide translations of the English version of the Terms into other languages for your convenience, you acknowledge that the English version governs your relationship with INMYTRIP. In the event of any discrepancies between the English version and a translation, the English version of the Terms will prevail.
            

2. Use of Services and content policy

2.1 INMYTRIP runs a sophisticated online platform where users adhering to these Terms can list, sell, and purchase tour packages. Any individual ("User") who inquires about or purchases products or services from InMytrip through its websites, mobile applications, sales representatives, offices, call centers, branch offices, franchisees, agents, etc. (collectively referred to as "Sales Channels") agrees to be bound by this User Agreement. The websites and mobile applications of InMytrip are collectively referred to as the "Website".
2.2 INMYTRIP partners with certain entities to offer extra travel and tourism services. When you choose these services, you understand that you are stepping outside the scope of our Platform, and INMYTRIP has no control over the terms provided by these third parties. It is your responsibility to review and accept the terms and conditions of these third-party providers. INMYTRIP is not responsible for any services you use or payments you make to them. You can opt out of these additional services in accordance with our Privacy Policy.
2.3 INMYTRIP does not manage or bear responsibility for several aspects of the Platform, such as advertisements, user interactions, and links to third-party websites. By using the Platform, you may encounter a variety of content, and INMYTRIP is not accountable for any content that is offensive, incorrect, or objectionable. INMYTRIP reserves the right to reject, remove, or relocate any content that breaches these Terms. The Platform might include links to third-party websites that are not affiliated with INMYTRIP, and accessing these sites is at your own risk, with INMYTRIP disclaiming any responsibility.
2.4 You are entirely responsible for the content you post on the Service, ensuring you have the necessary rights and permissions for it. Although you retain ownership, by submitting content, you grant INMYTRIP a license to use, reproduce, and display it for Platform-related purposes. INMYTRIP may automatically create ad descriptions from uploaded images, but they do not guarantee their accuracy. Users have a non-exclusive license to access and contact you about the posted content. This license ends when the content is removed. Additionally, INMYTRIP may share your content with third parties for transaction purposes.
2.5 INMYTRIP disclaims any responsibility for content created by users. Copyright violations are prohibited, and INMYTRIP may delete infringing material upon receiving valid notice. The platform can revoke a user's access for repeated violations or breaches of these Terms. INMYTRIP retains the exclusive right to decide what content is appropriate.
2.6. Users must be at least 18 years old and possess the legal authority to enter into an agreement to become a User and utilize the services of InMyTrip. If you are under 18, you are not permitted to register as a User of the Website or transact on or use the Website.If a minor wishes to use or transact on the Website, such actions must be carried out by a person of legal contracting age, such as a legal guardian or parent. 
We reserve the right to terminate your membership and/or block access to the Website if it is discovered that you are a minor, legally incompetent to contract, or if any age-related information provided during account creation is false. Before using the Website, accessing any Sales Channels, or procuring the services of InMyTrip, Users must read and understand this User Agreement. By doing so, they are deemed to have accepted this User Agreement as a binding document governing their interactions and transactions with InMyTrip. If the User disagrees with any part of this Agreement, they must not use InMyTrip's services or access its Sales Channels. 
     

3. User's Obligation

3.1 Users are advised to carefully review the description of services and products before making a booking. By proceeding with the booking, the user(s) agree to adhere to all terms and conditions as outlined in the booking confirmation or specified in the confirmed booking voucher. These terms should also be read in conjunction with the User Agreement. If a User makes a booking on behalf of another individual, it is the User's responsibility to inform that individual of the terms of this agreement, including all applicable rules and restrictions. The User agrees to follow all procedures and guidelines, as updated periodically, related to the use of services provided by InMyTrip. Additionally, the User commits to comply with all relevant laws, regulations, orders, and directions issued by the Central Government, State Government, District Authorities, or any other authorized statutory body concerning the use of services or specific transactions. The services are offered on an "as is" and "as available" basis. InMyTrip may, at its sole discretion and without prior notice, modify the features or functionality of the services provided. InMyTrip explicitly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. No advice or information, whether oral or written, obtained by the User from InMyTrip or through the selected services, will create any warranty not explicitly stated in these terms and conditions. The User also authorizes InMyTrip's representatives to contact them via phone, message, and email. This consent overrides any preferences set by the User through the national customer preference register (NCPR) or any other similar preference settings.
3.2 Personal information such as name, email, age, gender, and payment details will be collected for booking purposes only. Personal data will be used solely for processing bookings and improving user experience. User data will not be shared with third parties except for service providers directly involved in the booked travel services. Users are encouraged to provide emergency contact information at the time of booking. Users must disclose any medical conditions that may affect their participation in activities. Users must adhere to all safety instructions provided by guides and service providers.
3.3 Requirements for creating an account, such as providing accurate personal information and agreeing to terms of service. Users are responsible for maintaining the confidentiality of their account credential. Conditions under which InMyTrip may terminate or suspend user accounts.
All rights and liabilities of the User and InMyTrip concerning any services or products facilitated by InMyTrip are limited to the scope of this User Agreement.
      

4. Conduct

You agree not to post, email, message, host, display, upload, modify, publish, transmit, store, update, or share any information on the Platform, or otherwise make available Content:
4.1 that violates any law or regulation;
4.2 that is copyrighted or patented, protected by trade secret or trademark, or otherwise subject to third-party proprietary rights, including privacy and publicity rights unless you are the owner of such rights or have permission or a license from their rightful owner to post the material and to grant INMYTRIP all of the license rights granted herein;
4.3 that infringes any of the foregoing intellectual property rights of any party or is Content that you do not have a right to make available under any law, regulation, contractual or fiduciary relationship(s);
4.4 that is harmful, abusive, unlawful, threatening, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy or other rights, including bodily privacy, insulting or harassing on the basis of gender, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or harms or could harm minors in any way, promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence or otherwise unlawful in any manner whatsoever or otherwise inconsistent with or contrary to the laws in force;
4.5 that harasses, degrades, intimidates, or is hateful towards any individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
4.6 that violates any (local) equal employment laws, including but not limited to those prohibiting the stating, in any advertisement for employment, a preference or requirement based on race, color, religion, sex, national origin, age, or disability of the applicant.
4.7 that threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation;
4.8 that includes personal or identifying information about another person without that person's explicit consent;
4.9 that impersonates any person or entity, including, but not limited to, an INMYTRIP employee, or falsely states or otherwise misrepresents an affiliation with a person or entity;
4.10 deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
4.11 that is false, deceptive, misleading, deceitful, misinformative, or constitutes a "bait and switch" offer;
4.12 that constitutes or contains "pyramid schemes," "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," or unsolicited advertisements of a commercial nature;
4.13 that constitutes or contains any form of advertising or solicitation if (1) posted in areas or categories of the Platform which are not designated for such purposes; or (2) e-mailed to INMYTRIP users who have requested not to be contacted about other services, products, or commercial interests;
4.14 that includes links to commercial services or Third Party Websites, except as specifically allowed by INMYTRIP;
4.15 that advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by applicable law;                
4.16 that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment or any other computer resource;
4.17 that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Service or that otherwise negatively affects other users' ability to use the Service; or
4.18 that employs misleading email addresses, forged headers, or otherwise manipulated identifiers to disguise the origin of Content transmitted through the Service.
4.19 that belongs to another person and to which you do not have any right;
4.20 that is harmful to the child;
4.21 that deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
4.22 Users are expected to treat tour guides, fellow travelers, and locals with respect. Any form of harassment, illegal activity, or disruptive behavior during trips is strictly prohibited. Violation of the user conduct policy may result in removal from the tour without refund and potential banning from future bookings.

Additionally, you agree not to:
                
4.22 contact anyone who has asked not to be contacted or makes unsolicited contact with anyone for any commercial purpose, specifically, contact any user to post an advertisement on a third-party website or post any advertisement on behalf of such user; or to "stalk" or otherwise harass anyone;
4.23 make any libelous or defamatory comments or postings to or against anyone;
4.24  collect personal data about other users or entities for commercial or unlawful purposes;
4.25 use automated means, including spiders, robots, crawlers, data mining tools, or the like to download or scrape data from the Service, except for internet search engines (e.g., Google) and non-commercial public archives (e.g., archive.org) that comply with our robots.txt file;
4.26 attempt to gain unauthorized access to computer systems owned or controlled by INMYTRIP or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service or the Platform.
4.27 use any form of automated device or computer program (sometimes referred to as "flagging tools") that enables the use of INMYTRIP's "flagging system" or other community control systems without each flag being manually entered by a human that initiates the flag (an "automated flagging device"), or use any such flagging tool to remove posts of competitors, other third parties or to remove posts without a reasonable good faith belief that the post being flagged violates these Terms or any applicable law or regulation.
4.28 use any automated device or software that enables the submission of automatic postings on INMYTRIP without human intervention or authorship (an "automated posting device"), including without limitation, the use of any such automated posting device in connection with bulk postings or for automatic submission of postings at certain times or intervals; or
4.29 Any Content uploaded by you shall be subject to relevant laws and may be disabled, or may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Site, we may terminate your account/block your access to the Site and we reserve the right to remove any non-compliant Content uploaded by you.
    

5. Paid Services

We may impose charges for utilizing certain areas of the Service ("Paid Services"). By utilizing Paid Services on the Website, you enter into an agreement with INMYTRIP, governed by the terms outlined herein. Provisions of the Terms related to the Content are also applicable to Paid Services. Moreover, you remain bound by the Terms concerning your use of the Platform and Services. The terms of Paid Services and the association between you and INMYTRIP are governed by the laws of India. Any claims against INMYTRIP are subject to resolution through mutual discussions or negotiations between you and INMYTRIP. If a dispute remains unresolved within 15 days of discussions, arbitration by a mutually appointed sole arbitrator will follow, in accordance with the Arbitration and Conciliation Act, 1996. We retain the right to modify the price at which these features are made available to you:
                • Featured Ads
                Featured Ads highlight your advertisement in a designated area of the Website, distinguishing it from other content. The display is sequential, and the duration is either as specified at purchase or 30 days from the original posting date, whichever is earlier. There is no limit to the volume of Featured Ads you may post. You can buy a single ad or bulk packages at discounted prices. INMYTRIP reserves the right to limit the extent and manner in which Featured Ads may be edited by you.           
                             
 Payment for Paid Services
                Payment is processed through third-party payment gateways. You may provide your GSTIN, and prices are inclusive of applicable taxes. Refunds are not applicable for unutilized time, but equivalent units are credited for technical glitches preventing feature utilization. The refund policy does not apply if your advertisement violates the Terms, faces abuse reports, or is deleted due to subsequent editing by you.
                
                You have the ability to provide us your Goods and Services Tax Identification Number (GSTIN) on the platform. Your GSTIN details are mandatory for passing on the credit of GST charged. In case you fail to provide us with your GSTIN details, we will assume that you are not registered with the GST authorities, without independently verifying your registration status.
                 Unless otherwise mentioned on the Website, prices indicated are inclusive of applicable taxes.
 Refunds/Cancellation
                 If you choose to delete or deactivate any Paid Services prior to the period for which it is active, we will not be liable to refund you for any unutilized time. In the event you are not able to avail of the Paid Services on the Website on account of any technical reasons, on receipt of payment confirmation, equivalent units of the paid feature against the ad units you were not able to post shall be credited to your account. For example, if you buy a package of 3 Featured Ad units out of which you have consumed only 2 units and were unable to post the remaining 1 ad unit as a Featured Ad on account of a technical glitch during the lifetime of the package validity, you will be credited only 1 unit of Featured Ad to your account.
                The above refund policy shall not be applicable in the event any content in your advertisement is found to be violating the Terms or there has been any abuse reported in relation to your advertisement or your advertisement is deleted or not re-posted on the Website on account of any technical reasons due to any subsequent editing done by you.

6. Governing Law

These terms and conditions for tours and travel services offered by InMyTrip.com are governed by the laws of India. Any disputes arising out of or relating to these terms and conditions, including but not limited to bookings, cancellations, refunds, or tour experiences, shall be subject to the exclusive jurisdiction of the courts in India.
By booking a tour with InMyTrip.com, you agree to submit to the jurisdiction of the courts in India for the resolution of any disputes. It is important to note that these terms and conditions are created in accordance with Indian laws and regulations governing travel services.
          

7. Right to cancellation

The User agrees to provide InMyTrip with accurate and valid information while using the Website under this User Agreement, and not to misrepresent any facts. Any failure on the User's part will result in the User being disqualified from using InMyTrip's services. If InMyTrip discovers or suspects at any time, either during or after receiving a service request from the User, that the request is unauthorized or that the information provided by the User or any travelers is incorrect or misrepresented, InMyTrip has the right to seek appropriate legal remedies against the User, including canceling the bookings without prior notice. In such cases, InMyTrip will not be liable for any loss or damage caused to the User or any other individual due to the cancellation of the booking or services.
If any judicial, quasi-judicial, investigative agency, or government authority requests InMyTrip to cancel a booking, InMyTrip will do so without notifying the affected User. The User shall not hold InMyTrip liable for any loss or damage resulting from actions taken by InMyTrip to protect its interests and those of its genuine customers. This includes InMyTrip denying or canceling bookings due to suspected fraudulent transactions.
   

8. Payment, Booking and modification policy

 8.1 Users are encouraged to book tours and travel services well in advance to ensure availability.
8.2 Users can modify their bookings up to 7 days before the trip, subject to availability and a modification fee.
8.3 Users can pay via credit/debit cards, PayPal, or direct bank transfers.
8.4 Full payment is required at the time of booking for trips under $500. For trips over $500, a 50% deposit is required, with the balance due 30 days before the trip.
8.5 Every booking made via InMytrip is subject to cancellation charge, Refunds will be processed within 7-10 business days of a cancellation request and as per our Refund and Cancellation policy [Referred to ].
8.6  InMyTrip’s liability for any loss or damage during tours is limited to the value of the booked trip. InMyTrip.com is not responsible for cancellations or changes due to events beyond its control (e.g., natural disasters, political unrest). All information provided on the website is for guidance only, and users should verify details independently.
8.7 Procedures for requesting changes to bookings, including deadlines and applicable fees. Modifications are subject to availability and may incur additional charges. Changes are not confirmed until the user receives a notification from Inmytrip.com

9. Review/feedback and environmental responsibility policy

  
                9.1 Users are encouraged to leave reviews and feedback after their trips to help improve services.Feedback will be used to enhance the quality of tours and travel experiences offered by InMyTrip.com. Users who leave detailed reviews may receive discounts or special offers on future bookings.
9.2 Inmytrip.com is committed to promoting sustainable tourism practices. Users are encouraged to minimize their environmental impact by reducing waste and conserving resources during trips. InMyTrip.com supports local communities and encourages users to respect local cultures and contribute positively.
   

10. Refund and Cancellation Policy

For any booking cancellations by the user, if cancellations are made 30 days or more before departure, a full refund of the tour cost will be provided, minus a 5% processing fee. If cancellations are made 15-29 days before departure, a 50% refund of the tour cost will be given. For cancellations made 7-14 days before departure, a 25% refund of the tour cost will be issued. No refunds will be available for cancellations made less than 7 days before departure. If InMyTrip cancels the booking due to not meeting the minimum participant requirement, a full refund of the tour cost will be provided. In the event of unforeseen circumstances such as natural disasters or political instability, a full refund of the tour cost will be offered or an option to reschedule the tour at no extra cost. No refunds will be given for no-shows or failure to join the tour at the scheduled departure time. Additionally, no refunds will be issued for partially used services, including accommodations, meals, or activities. Refunds for bookings made under special offers or discounts will be calculated based on the actual amount paid, not the full price of the tour. In the case of a request for a refund, please ensure that your email includes all necessary booking details and a clear explanation for the cancellation. This helps expedite the processing of your request. Changes to bookings made 15 days or more before departure will not incur any fees, subject to availability. Changes made less than 15 days before departure will incur a 10% processing fee. We strongly recommend purchasing travel insurance to cover unforeseen circumstances that may require you to cancel your trip. To request a refund, all requests must be submitted in writing via email to [[email protected]] with the booking details and reason for cancellation. Refund requests will be processed within 14 business days of receiving the request. We understand that plans can change unexpectedly, and we aim to provide as much flexibility as possible within our policies. Our goal is to make your experience with InMyTrip enjoyable and hassle-free, whether you are booking, modifying, or cancelling your trip. We also encourage you to review our terms and conditions thoroughly before making any bookings to ensure you are fully aware of our policies.
