This may include removing any non-compliant information, as specified by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. By interacting with the InMyTrip platform and using our services, you agree to abide by these terms. If you do not agree with them, please refrain from using the platform and its services.
EMBELLISHED DREAM TOURS PRIVATE LIMITED, an Indian company registered under the Companies Act, 2013, and based at 73/2, Kamalnagar, Mirjanhat, Bhagalpur, Bihar (referred to as "INMYTRIP"), operates and manages the Platform. This Platform includes online resources such as classified advertisements on the website www.inmytrip.com and its mobile application, as well as an online service that connects tourism service providers with selected partners on www.inmytrip.com (collectively referred to as the "Service"). Both the Service and the Platform, including their websites and mobile applications, are governed by these INMYTRIP Terms of Use ("Terms").
For the purposes of these Terms, “you” ,”your”, “Vendors” refer to any individual who uses the platform for advertisement, marketing and receive booking purposes or the Service, whether manually or automatically. This includes individuals browsing the Platform, sharing tourism information for price estimates, posting comments or content, or responding to advertisements on the Platform. By using the Service, you agree to comply with these Terms. Furthermore, when using specific parts of the Service, you agree to follow any applicable guidelines. These guidelines may be modified or updated at INMYTRIP's sole discretion. It is your responsibility to periodically review these Terms. If you disagree with any term, condition, guideline, or any subsequent changes, or if you are dissatisfied with INMYTRIP or the Service, your only option is to immediately stop using INMYTRIP.
INMYTRIP reserves the right to modify these Terms at any time at its sole discretion. Notices of changes to the Platform or the Terms may be sent to you by INMYTRIP as described in Section 4.21 (4). Although INMYTRIP may provide translations of the English version of the Terms into other languages for your convenience, you acknowledge that the English version governs your relationship with INMYTRIP. In the event of any discrepancies between the English version and a translation, the English version of the Terms will prevail.
2.1 Vendor is responsible for providing precise, comprehensive, and current information about all services listed on InMyTrip.com. This includes detailed descriptions, accurate pricing, high-quality images, and any other relevant details that can help customers make informed decisions. It is crucial that the information provided remains accurate and is regularly updated to reflect any changes or new offerings. Misleading or incorrect information can result in customer dissatisfaction and potential removal from the platform. 2.2 Vendor is committed to maintaining the highest standards of quality for all services offered through InMyTrip.com. This means ensuring that accommodations, tours, transportation, and any other services meet or exceed customer expectations. Vendors must consistently deliver excellent service, ensuring that all customer experiences are positive and memorable. Regular reviews and feedback will be monitored to ensure compliance with these quality standards, and vendors may be required to address any issues promptly to maintain their listing on the platform. 2.3 Vendor must ensure that the services listed on InMyTrip.com are available for booking as advertised. This involves keeping the availability status up-to-date and promptly reflecting any changes in service availability. Accurate availability information is essential to prevent overbooking and to ensure a smooth booking process for customers. Vendors should use the provided tools and interfaces on InMyTrip.com to manage their inventory and ensure that customers have access to real-time booking information. 2.4 Vendor is required to offer timely and effective customer support to address any issues or queries from customers. This includes being accessible and responsive to customer inquiries, resolving complaints or issues swiftly, and providing assistance throughout the customer’s travel experience. Providing excellent customer support is vital for maintaining high levels of customer satisfaction and fostering a positive reputation on InMyTrip.com. Vendors should ensure that their customer service team is well-trained, knowledgeable, and prepared to handle a wide range of customer needs. 2.5 For marketing purposes vendors are required to use their own business name and the selected name should be copyright free and the vendor will be responsible for any kind of copyright infringement. InMyTrip strictly prohibits the use of Intellectual properties from third parties by the vendors.
3.1 Vendors will receive a booking gig in 999 INR/year which is non-refundable. 3.2 InMyTrip will retain a commission fee amounting to 10% of the total cost for every booking made through its platform. The remaining 90% of the payment will be directly transferred to the vendor's account. Any applicable taxes and additional charges will be subject to separate terms and conditions. 3.3 The payment for the vendor will be transferred into their account one day before the exact booking date. In the event of a delay, the payment will be transferred within 2-3 days after the scheduled date. 3.4 Upon the confirmation of a booking, if the vendor subsequently refuses to provide the agreed-upon service to the customer, InMyTrip reserves the right to terminate the vendor's account. Additionally, InMyTrip may pursue legal action against the vendor in accordance with the relevant local governing laws. 3.5 Registration on the Platform is free of cost for vendors. InMyTrip doesn't levy any charges for browsing, marketing or registering on the Platform. In its discretion, InMyTrip may introduce new services or modify existing ones offered on the Platform. In such cases, InMyTrip reserves the right to implement fees for the new services introduced or revise existing service fees accordingly. Any alterations to the fee policy will be communicated on the Platform, and they will be effective immediately upon posting. Unless stated otherwise, all fees will be denoted in Indian Rupees (INR) and payable to InMyTrip. You are responsible for adhering to all relevant laws while making payments to InMyTrip.
4.1 If you use the InMyTrip platform, you are responsible for maintaining the confidentiality of your display name and password, and you will be accountable for all activities that occur under your display name and password. You agree that if you provide any information that is untrue, inaccurate, outdated, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, outdated, or incomplete, or not in accordance with these Terms of Use, we have the right to indefinitely suspend, terminate, or block access to your membership on the platform and refuse to provide you with access to the platform. 4.2 Your mobile phone number and email address are used as your primary identifiers on the InMyTrip platform. It is your responsibility to keep these details updated at all times. If your mobile phone number or email address changes, you agree to promptly notify us by updating this information on the platform through a one-time password verification process. 4.3 You agree that InMyTrip shall not be liable or responsible for any activities or consequences resulting from the use or misuse of any information under your account, particularly in cases where you have failed to update your revised mobile phone number and/or email address on the website platform. 4.4 You are responsible for keeping your account information confidential and for all activities that occur under your account. You must not share your login details, including your username and password, with anyone else, as this would be considered a breach of the Terms of Use of InMyTrip.
In these terms, the term "Posting Agent" refers to a third-party agent, service, or intermediary that proposes to post Content to the Service on behalf of others. The use of Posting Agents, whether directly or indirectly, is strictly prohibited by INMYTRIP without explicit written permission. Furthermore, Posting Agents are not allowed to post Content on behalf of others, either directly or indirectly, or access the Service to post Content for others unless granted express written permission or a license by INMYTRIP.
INMYTRIP provides you with a limited, revocable, non-exclusive license to access and use the Service for personal purposes. This license explicitly excludes the following: (a) access or use of the Service by Posting Agents; or (b) any form of collection, aggregation, copying, duplication, display, or derivative use of the Service, as well as the use of data mining, robots, spiders, or similar tools for extraction, unless expressly permitted by INMYTRIP or as otherwise outlined in these Terms.
However, there is an exception for general-purpose internet search engines and non-commercial public archives that collect information solely for displaying hyperlinks to the Service. To qualify for this exception, these entities must operate from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. Such activities should be in line with (b) above.
For clarity, a "general-purpose internet search engine" does not encompass websites or search engines specializing in classified listings or any subset of classifieds listings. The license outlined in this section allows you to display individual postings on your website or create hyperlinks, strictly for non-commercial and/or news reporting purposes (e.g., personal blogs or other personal online media). However, exceeding posting limits set by INMYTRIP without express permission will be considered a violation of these Terms.
You may also create a hyperlink to the Platform's home page as long as it does not present INMYTRIP, its employees, affiliates, or agents in a false, confusing, misleading, derogatory, or offensive manner. Any use of the Service beyond the authorized access defined in these Terms immediately terminates the granted permission or license. If you intend to collect, aggregate, copy, duplicate, display, or make derivative use of the Service or any Content for purposes not expressly stated herein (including commercial purposes), you must obtain a license from INMYTRIP.
However, there is an exception for general-purpose internet search engines and non-commercial public archives that collect information solely for displaying hyperlinks to the Service. InMyTrip Tourism Company recognizes the importance of protecting intellectual property rights, both our own and those of our vendors. All intellectual property created or developed by vendors in the course of their engagement with InMyTrip Tourism Company shall remain the property of the respective vendor, unless otherwise agreed upon in writing. InMyTrip acknowledges that vendors may possess proprietary information and trade secrets, and commits to safeguarding such information from unauthorized disclosure or use. Vendors retain the right to use their intellectual property for purposes not directly related to their engagement with InMyTrip, unless otherwise stipulated in contractual agreements. Vendors are encouraged to clearly mark their intellectual property with appropriate copyright, trademark, or other proprietary notices. Vendors are responsible for promptly notifying InMyTrip of any suspected or actual infringement of their intellectual property rights. All parties involved in the creation, development, or utilization of intellectual property shall maintain strict confidentiality regarding proprietary information, trade secrets, and other sensitive materials. In conclusion, the Intellectual Property Rights Policy of InMyTrip underscores its commitment to upholding the rights of vendors over their intellectual creations and innovations. By fostering a culture of respect, transparency, and fairness, InMyTrip aims to nurture fruitful collaborations with its vendors while safeguarding their intellectual property rights.
You acknowledge and agree that the materials on the Platform, excluding User Content licensed under Section II(iii) of the Terms, such as text, software, scripts, graphics, photos, sounds, music, videos, interactive features ("Materials"), and the trademarks, service marks, and logos ("Marks") contained therein, are licensed to INMYTRIP and are subject to copyright and other intellectual property rights under Indian law. Certain trademarks displayed on the Platform may belong to third parties, and their use is subject to the licenses granted by those third parties to INMYTRIP. You are prohibited from reverse engineering, decompiling, or disassembling such trademarks, and nothing in these Terms grants you any rights related to such trademarks.
Materials on the Platform are provided on an 'AS IS' basis for your information. They may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes without the prior written consent of the respective owners or licensees. INMYTRIP reserves all rights not expressly granted herein to the Platform and the Materials.
You agree not to engage in the use, copying, or distribution of any Materials other than as expressly permitted herein, including any use, copying, or distribution of Materials of third parties obtained through the Platform for commercial purposes. If you download or print a copy of the Materials for personal use, you must retain all copyright and other proprietary notices.
You agree not to circumvent, disable, or otherwise interfere with security-related features of the Platform or features that prevent or restrict the use or copying of any Materials. The Service is protected to the maximum extent permitted by copyright laws and other applicable laws in India.
The content displayed on or through the Service is protected by copyright as a collective work and/or compilation. Reproduction, modification, creation of derivative works, or redistribution of the Platform, the Materials, or the collective work or compilation is expressly prohibited. Copying or reproducing the Platform, the Materials, or any portion thereof for further reproduction or redistribution is expressly prohibited. You further agree not to reproduce, duplicate, or copy Content or Materials from the Service and to abide by all copyright notices and other notices displayed on the Service. Decompiling, disassembling, or attempting to discover any source code contained in the Service is not allowed. Additionally, you agree not to exploit any aspect of the Service for commercial purposes.
INMYTRIP assumes no responsibility for any infringement of intellectual property rights arising from materials posted on or transmitted through the site, or items advertised on the site, by end-users, or any other third parties.
If you are the owner of intellectual property rights or an authorized agent acting on behalf of the owner and believe that any Content or other content infringes upon your intellectual property right or the right of the owner you represent, you may submit a notification to INMYTRIP. This should be accompanied by a request for INMYTRIP to, in good faith, remove the relevant Content. You can use the claims of infringement form available here.

You acknowledge that while using the Platform, you may encounter Content from various sources, and INMYTRIP is not accountable for the accuracy, usefulness, safety, or intellectual property rights of such Content. You accept and bear all liability for your use of the Platform. Additionally, you understand and recognize that you might come across Content that is inaccurate, offensive, indecent, objectionable, defamatory, or libelous. In doing so, you agree to waive any legal or equitable rights or remedies you may have or acquire against INMYTRIP concerning such Content.
You agree to protect, indemnify, and hold INMYTRIP, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers, and employees harmless from any and all claims, damages, obligations, losses, liabilities, costs, or debts, including attorneys' fees, arising from (i) your use of and access to the Platform and/or the Service; (ii) your violation of any term of these Terms; (iii) your infringement of any third-party right, including but not limited to any copyright, trademark, trade secret, or other property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will remain in effect even after the termination, modification, or expiration of these Terms and your use of the Service and the Platform.
You acknowledge and consent that the transmission of unsolicited email advertisements or other uninvited communications to INMYTRIP email addresses or through INMYTRIP computer systems is explicitly prohibited by these Terms. You recognize and agree that INMYTRIP may, at times, employ human monitors or automated software to assess email usage, flagging certain words associated with spam or scams in emails exchanged between users within the INMYTRIP email system. The use of communication features on the Service and the Platform between you and any other user must adhere strictly to the Terms. Unauthorized use of INMYTRIP computer systems constitutes a violation of these Terms and may result in civil and criminal penalties for the sender and their agents.
You acknowledge and agree that INMYTRIP is not liable for any interactions you have with organizations and/or individuals on the Platform or through the Service. This includes interactions with representatives of our select partners, as well as the payment and delivery related to travel packages. Any terms, conditions, warranties, or representations associated with such interactions are solely between you and the respective organizations and/or individuals. INMYTRIP is not responsible or liable for any loss or damage incurred as a result of these dealings or interactions. In case of disputes between participants on the Platform or between users and any third party, you understand and agree that INMYTRIP is not obligated to intervene in such disputes. If you have a dispute with one or more other users, you release INMYTRIP, its officers, employees, agents, and successors from any and all claims, demands, and damages (actual and consequential) arising out of or related to such disputes and/or our Service, whether known or unknown, suspected or unsuspected, disclosed or undisclosed.
You acknowledge and agree that INMYTRIP may set limits on the use of the Service, including the maximum number of days Content will be retained, the size of postings, email messages, or other Content, and the frequency and manner of accessing the Service or the Platform. Your account is identified and linked through your mobile number, Facebook account, or email address used for registration. INMYTRIP reserves the right to remove or restrict the usage of duplicate accounts linked through the same mobile number, Facebook account, or email address. INMYTRIP is not responsible for the deletion or failure to store any Content. INMYTRIP may modify, limit, or discontinue the Service (or any part thereof) with or without notice. INMYTRIP has the right, at its sole discretion, to delete or deactivate your account, block your email or IP address, or terminate your access to the Service immediately and without notice, removing any Content, for any reason or no reason, including if it believes you violated these Terms. INMYTRIP is not liable for any termination of your access to the Platform or the Service, and you agree not to attempt to use the Service after such termination.
You expressly acknowledge and agree that the use of the platform and the service is entirely at your own risk, and they are provided on an "as is" or "as available" basis, without any warranties of any kind. All express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement of proprietary rights, are disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, INMYTRIP, along with its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the platform and your use thereof. INMYTRIP makes no warranties or representations about the accuracy or completeness of the platform's content or the content of any third-party websites linked to the platform and assumes no liability or responsibility for any: (i) Errors, mistakes, or inaccuracies of content, (ii) Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the platform and service, (iii) Any unauthorized access to or use of our servers and/or any and all personal information and/or financial information stored therein, (iv) Any interruption or cessation of transmission to or from the platform, (v) Any bugs, viruses, trojan horses, or the like transmitted to or through the platform by any third party, and/or (vi) Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, communicated, transmitted, or otherwise made available via the platform or the service. INMYTRIP does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the platform or any hyperlinked website or featured in any banner or other advertising. INMYTRIP will not be a party to or responsible for monitoring any transaction between you, other users, and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.
In no event shall INMYTRIP, its officers, directors, employees, or agents be liable for direct, indirect, incidental, special, consequential, or exemplary damages (even if INMYTRIP has been advised of the possibility of such damages), resulting from any aspect of your use of the platform or the service. This includes, without limitation, damages arising from the use or misuse of the platform or the service, inability to use the platform or the service, or the interruption, suspension, modification, alteration, or termination of the platform or the service. Such limitation of liability shall also apply with respect to damages incurred by reason of other services or products received through or advertised in connection with the platform or the service or any links on the platform. Additionally, it applies to damages arising from any information, opinions, or advice received through or advertised in connection with the platform or the service or any links on the INMYTRIP site. These limitations shall apply to the fullest extent permitted by law. You specifically acknowledge and agree that INMYTRIP shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any user or third party, and that the risk of harm or damage from the foregoing rests entirely with you. The platform is controlled and offered by INMYTRIP. INMYTRIP makes no representations or warranties that the platform is appropriate for use in other locations. Those who access or use the platform from other jurisdictions do so at their own volition and risk and are responsible for compliance with local law.
You may not transfer or assign these Terms, and any rights and licenses granted hereunder, but INMYTRIP may assign them without restriction. Any attempt by you to transfer or assign shall be null and void.
You confirm that you are at least 18 years old and have the legal capacity to agree to and comply with these Terms. This Platform is designed for adults, and you assert that you are legally qualified to enter into contracts according to applicable laws. If you are using or accessing this Platform on behalf of someone else, you assert that you have the legal authority to represent that individual or entity. Users under the age of 18 (minors) can only access the Platform with the prior approval of their legal guardian. Minors are prohibited from using the Service. As per Indian law, minors lack the capacity to enter into contracts with third parties, and therefore, they cannot engage in transactions through the Platform. If you are a minor under Indian law, please refrain from conducting any transactions on the Platform. Legal guardians of minors acknowledge that they cannot enter into contracts on behalf of minors or bind them in transactions. As the legal guardian, you recognize that you are entering into independent agreements with third parties, even if you are doing so at the request of a minor. NOTICE TO MINORS: If you are a minor, please refrain from providing us with your personal information, such as email addresses, name, and contact details. If you wish to contact us, kindly do so through your parent or legal guardian.
These Terms, along with other policies presented on the Platform, constitute the comprehensive and exclusive understanding and agreement between you and INMYTRIP, governing your use of the Services and the Platform. They supersede all prior understandings, proposals, agreements, negotiations, and discussions, whether written or oral, between you and INMYTRIP. The Terms and the relationship between you and INMYTRIP are governed by the laws of India. Any claims against INMYTRIP shall be resolved through mutual discussions or negotiations. If a dispute remains unresolved within fifteen (15) days, arbitration by a mutually appointed sole arbitrator will follow, as per the Arbitration and Conciliation Act, 1996. The failure of INMYTRIP to enforce any right or provision of the Terms does not constitute a waiver. If a court deems any provision invalid or inapplicable, both parties agree to seek the court's interpretation in line with their original intention. If any provision is deemed invalid, illegal, or unenforceable, the remaining provisions' validity, legality, and enforceability shall remain unaffected. These Terms apply to and bind the successors and assigns of both you and INMYTRIP.
If you become aware of any violations of the Terms, please report them by contacting us through the link at the bottom of the INMYTRIP homepage at www.inmytrip.com. INMYTRIP's failure to act immediately in response to a breach by you or others does not waive the right to act in response to subsequent or similar breaches. Due to the difficulty of quantifying damages, you agree to pay INMYTRIP the following as liquidated damages (and not as a penalty) if actual damages cannot be reasonably calculated: I. If INMYTRIP establishes limits on your Service access frequency or terminates your access, you agree to pay INMYTRIP Rs 10,000/- for each message posted beyond limits or each day accessing INMYTRIP beyond set limits, whichever is higher. II. Posting Agents violating Terms agree to pay INMYTRIP Rs 10,000/- for each posted item. The engaging party agrees to pay an additional Rs 10,000/- for each item posted by the Posting Agent on their behalf in violation. III. Using INMYTRIP systems for unsolicited e-mail ads incurs a charge of Rs 2500/- for each such e-mail. IV. Posting messages in violation of Terms, except as above, incurs a charge of Rs 10,000/- for each message. V. Unauthorized exploitation of Content (excluding your own) results in a charge of Rs 10,00,000/- for each day of such conduct. VI. If none of the above applies, you agree to pay INMYTRIP s actual damages. INMYTRIP retains the right to seek equitable remedies, including specific performance or injunction, without posting a bond.
Sellers acknowledge that Inmytrip.com is a booking platform connecting them with users and is not responsible for the fulfillment or quality of services. Sellers must promptly confirm bookings. A confirmation email will be sent to users upon approval. Inmytrip.com processes user payments securely. Sellers will receive payments as per the agreed schedule with Inmytrip.com. Sellers must provide a clear cancellation and refund policy. This policy should be communicated to users before booking. Any changes to a booking requested by users should be handled directly by the seller. Sellers must inform users of any additional charges or modifications. Sellers must inform users and Inmytrip.com of any necessary changes to the itinerary due to unforeseen circumstances such as weather or strikes. Sellers must provide accurate and complete information about their services. Inmytrip.com is not liable for issues arising from incorrect or misleading information provided by sellers. Sellers are responsible for delivering services as described in the tour package. Any disputes or service quality issues must be resolved directly with users. Sellers must inform users of any necessary travel documents, such as passports and visas, required for the tour. Sellers should recommend that users purchase travel insurance to cover emergencies, cancellations, or lost luggage. Sellers must ensure that the tour is safe and that users are informed of any health and fitness requirements. Sellers are not liable for users' health issues during the tour. Sellers have the right to terminate the tour of any traveler who poses a risk to others or engages in disruptive behavior. This should be done in accordance with local laws and customs. Sellers must specify any age restrictions for their tours and ensure these are clearly communicated to users. Sellers should make reasonable efforts to accommodate special requests from users, such as dietary requirements or room preferences, but cannot guarantee fulfillment. Sellers must ensure that all accommodations meet local standards of comfort and safety. Sellers must clearly specify which meals are included in the tour package. Additional meals and beverages are the responsibility of the traveler. Sellers must specify the transportation included in the tour package and inform users of any changes or delays in transportation schedules. Sellers must obtain users' consent for photography and the use of their images for promotional purposes. Sellers must address complaints reported by users immediately. Unresolved issues should be documented and reported to Inmytrip.com. Sellers must comply with Inmytrip.com’s Privacy Policy, ensuring the protection of users' personal information. Sellers acknowledge that Inmytrip.com may amend these terms at any time and will be notified of significant changes. Continued use of the platform constitutes acceptance of updated terms. These terms are governed by the laws of the jurisdiction in which Inmytrip.com operates. Any legal action must be brought in the courts of that jurisdiction.
